Acquittals at Trial
Following a jury trial, we obtained acquittals of first-degree assault and robbery charges, thereby preventing our client from receiving what would have been his first criminal convictions and a mandatory term of imprisonment. (Denver District Court)
Dismissals of Criminal Charges
We secured pretrial dismissals of assault charges pending against two clients in separate matters, one of them involving allegations of domestic violence. (Boulder County District Court; Denver District Court)
Successful Sentence Challenge under 28 U.S.C. § 2255
In a federal habeas action for a client sentenced under the Armed Career Criminal Act, we obtained an order vacating the original 188-month sentence and resentencing the client to “time served,” thereby securing his immediate release from prison. (U.S. District Court for the District of Colorado)
Successful Post-Conviction Litigation
As co-counsel in a state post-conviction challenge under Rule 35(c) of the Colorado Rules of Criminal Procedure, we helped persuade a judge to vacate our client’s convictions for kidnapping and sex assault and order a new trial. (Arapahoe County District Court)
Prisoner Advocacy
Without resorting to the expense and delay of litigation, we obtained the prompt transfer of our client from a prison where he was being assaulted by other inmates to a different correctional facility where he believed he would be safer. (Colorado Department of Corrections)
Open Records Litigation
Under the Freedom of Information Act (FOIA), we obtained a partial victory in the form of a court order mandating disclosure of some of the government records sought by our client, as well as an award of related attorneys’ fees and costs against the federal agency defendant. Avoidance of Prosecution
The firm negotiated with prosecutors to avoid criminal charges being filed against our client, a state employee, for conduct related to that client’s work duties.
